TERMS & CONDITIONS

I. General Policy

 
 


BESHERT provides a way for adults to meet each other online and offline (social events, personal introductions, speed dating events, parties, etc). This is a legal agreement ("Agreement") between you and BESHERT. Please read the Agreement carefully before registering for BESHERT. By registering for BESHERT or using the BESHERT website, you become a Member of BESHERT and you agree to be bound by the terms and conditions of this Agreement (the "Terms") for as long as you continue to be a Member. If you do not agree to the terms, please do not register for BESHERT or use the BESHERT website. The terms are subject to change by BESHERT at any time, effective upon notice to you.
MINORS MAY NOT BECOME MEMBERS. By becoming a Member, you represent and warrant that you are at least 18 years old, Jewish, and either single, divorced, separated or widowed.
EVENTS WHERE ALCOHOL IS SERVED. By participating in events where alcohol is served, you represent and warrant that you are least 21 years of age or older.
TERMINATION OF SERVICE. Either you or BESHERT may terminate your BESHERT Membership at any time, for any reason, without explanation, effective upon sending written notice to the other party. BESHERT reserves the right to immediately suspend or terminate your access to BESHERT, without notice, upon any breach of this Agreement by you which is brought to BESHERT's attention. If your membership is terminated, you will not be entitled to any refund of unused subscription fees.
ASSIGNMENT OF MEMBERSHIP. Your Membership in the BESHERT service is for your sole, personal use. You may not authorize others to use your Membership, and you may not assign or otherwise transfer your account to any other person or entity.
INDEMNITY BY MEMBER: You will defend, indemnify, and hold harmless Elsa Malinsky (founder), BESHERT, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to or arising out of your use of the BESHERT service, including any breach by you of the terms of this Agreement.

PROPRIETARY RIGHTS: BESHERT owns and retains other proprietary rights in all services offered by BESHERT. BESHERT contains the copyrighted material, trademarks, and other proprietary information of BESHERT. In addition, other Members may post copyrighted information, which has copyright protection whether or not it is identified as copyrighted. Except for that information which is in the public domain or for which you have been given permission, you will not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.
By posting information or content to any public area of BESHERT, you automatically grant, and you represent and warrant that you have the right to grant, to BESHERT and other BESHERT Members, an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sub-licenses of the foregoing.

INFORMATION SUPPLIED BY MEMBER: BESHERT will keep confidential all information supplied by you to BESHERT, including credit card number(s), and shall use or disclose such information only for the purposes for which such information was collected, or as required by law.

COMPLAINTS: To resolve a complaint regarding the BESHERT service, you should first contact BESHERT Customer Support by clicking on the "Contact Us" button or via email to elsa@BESHERT.com.

DISCLAIMER OF WARRANTY. BESHERT provides service on an "as is" basis and grants no warranties of any kind, expressed, implied, statutory, in any communication with BESHERT or its representatives, or otherwise with respect to the service. BESHERT specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. BESHERT does not warrant that your use of the BESHERT service will be secure, uninterrupted, always available, or error-free, or will meet your requirements, or that any defects in the service will be corrected. BESHERT disclaims liability for, and no warranty is made with respect to, connectivity and availability.

LIMITATION OF LIABILITY. In no event will BESHERT be liable to you for any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of data, loss of programs, cost of procurement of substitute services or service interruptions) arising out of the use of or inability to use BESHERT, even if BESHERT or its agents or representatives know or have been advised of the possibility of such damages, or to any person other than you. Notwithstanding anything to the contrary contained herein, BESHERT's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to BESHERT for the service during the term of Membership.
BESHERT does not screen the Members registering for services offered by BESHERT in any way. As a result BESHERT will not be liable for any damages, direct, indirect, incidental and/or consequential, arising out of the use of this service, including, without limitation, to damages arising out of communicating and/or meeting with other Members of this service, or introduced to you via this service. Such damages include, without limitation, physical damages, bodily injury and or emotional distress and discomfort. BESHERT asks all prospective participants if they are Jewish, and if they are single, divorced, widowed, or separated. But we do not verify this information. Therefore, BESHERT is not liable for the integrity of statements made by Members as to their Jewish identity, marital status and general background. It is incumbent and advised upon the user to verify any and all information relating to but not limited to this subject. It is advised to check references of any Member.

II. Online Policy

ONLINE CONDUCT. As a Member, you agree that:
1. You are solely responsible for the content or information you publish or display (hereinafter, "post") on Beshert, or transmit to other Beshert Members.
2. You will not post on Beshert, or transmit to other Beshert Members or Employees, any defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, racially offensive, or illegal material, or any material that infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity).
3. You will use Beshert in a manner consistent with any and all applicable laws and regulations.
4. You will not include in your profile any telephone numbers, street addresses, last names, URL's or Email addresses other than where asked for it in the Confidential Personal Information section.
5. You will not include in your profile any offensive anatomical or sexual references, or offensive sexually suggestive or connotative language, and you will not post any photos containing nudity or personal information. Beshert reserves the right, but has no obligation, to reject any profile or photo that does not comply with these prohibitions.
6. You will not engage in advertising to, or solicitation of, other Members to buy or sell any products or services through Beshert. You will not transmit any chain letters or junk Email to other Beshert Members. For protection of Members against such conduct, Beshert has imposed a 30 message-per-day limit on subscribers.
7. You will not post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.
8. You are solely responsible for your interactions with other Beshert Members. Beshert reserves the right, but has no obligation, to monitor and/or mediate disputes between you and other Members.
You are responsible for logging out if your computer is accessible to others. This prevents unauthorized access.
ONLINE CONTENT: Opinions, advice, statements, offers, or other information or content made available through Beshert, but not directly by Beshert, are those of their respective authors, and should not necessarily be relied upon. Such authors are solely responsible for such content. Beshert does not guarantee the accuracy, completeness, or usefulness of any information on the service and neither adopts nor endorses nor is responsible for the accuracy or reliability of any opinion, advice, or statement made by parties other than Beshert. Under no circumstances will Beshert be responsible for any loss or damage resulting from anyone's reliance on information or other content posted on the Beshert website or transmitted to Beshert Members.

WARNING - PLEASE READ THIS: It is possible that other Beshert Members or users (including unauthorized users, or "hackers") may post or transmit offensive or obscene materials on the Beshert service and that you may be involuntarily exposed to such offensive and obscene materials. Beshert is not responsible for the use of any personal information that you disclose on the Service. Please carefully select the type of information that you post on the Beshert service or release to others.
Beshert reserves the right, but has no obligation, to monitor the materials posted in the public areas of the Beshert service. Beshert shall have the right to remove any such material that in its sole opinion violates, or is alleged to violate, the law or this agreement. Notwithstanding this right of Beshert, you remain solely responsible for the content of the materials you post in the public areas of the service and in your private email messages. Emails sent between you and other Beshert Members that are not readily accessible to the general public will be treated as private by Beshert to the extent required by applicable law.


III. Speed Dating and Events Policy Including Refunds and Cancellations

LIMITATION OF LIABILITY In participation in events sponsored by Beshert, you agree that Beshert and Elsa Malinsky, their agents, employees, event leaders, instructors, assistants, and representatives, shall not be liable, jointly or severally, for any injuries to your person or property. You also agree to indemnify and hold harmless the parties from and against any and all actions, claims, demands, loss, damage and expense of any kind, including attorney's fees, arising from such claims. You are aware and familiar with the risk involved in trips, events, lessons or sport and non-sport activities, and you understand that you are assuming those risks and will only engage in activities in which you are physically fit to participate.

EVENTS WHERE ALCOHOL IS SERVED By participating in events where alcohol is served, you represent and warrant that you are least 21 years of age or older.

A. Speed Dating

1. We make every effort to ensure an equal ratio of men to women, but we cannot always guarantee that ratio. Speed dating participants can expect a minimum of seven one-on-one conversations with participants of the opposite sex, though usually the number of conversations is significantly higher.
2. For participation in speed dating events, attendees are required to be within the age range of the event for which they have registered or to be given approval by Beshert to participate in that age group.
3. If the location of the speed dating event is not listed, then it will be given to confirmed participants within 48 hours prior to the event.
4. In the event of an imbalance in the ratio of men to women prior to the event, Beshert reserves the right either to reschedule participants for a later speed dating session or refund the full cost of the event.
5. Also, In the event of inclement weather or other unpredicted circumstances, Beshert reserves the right either to reschedule you for a later speed dating session or to refund the full cost of the event.
6. If you have a credit from a previous speed dating event and would like to use it, please email us at elsa@beshert.com at least one week prior to the event and specify which event you would like to attend.
7. We understand that people have personal emergencies. Please be considerate of other participants and notify us as early as possible if you cannot come. If you are unable to attend an event that you have registered for, please give us at least 72 hours notice. At the discretion of Beshert, you will get your refund (minus $5 service fee) or a credit for the next event in your age group.
8. "No shows" and participants who attend any portion of an event will forfeit the full event cost and will not be rescheduled.


B. Events

SINGLE DAY EVENT CANCELLATION AND REFUND POLICY. In the event of inclement weather or other unpredicted circumstances, Beshert reserves the right either to reschedule you for a later event or to refund the full cost of the event. If you have a credit from a previous event and would like to use it, please email us at elsa@beshert.com at least one week prior to the event and specify which event you would like to attend. If you are unable to attend an event that you have registered for, please give us at least 72 hours notice. At the discretion of Beshert, you will get your refund (minus $5 service fee) or a credit for the next event in your age group.
